On-Site Auction of Various Abandoned Dwellings

The auction is to be held on Saturday 11 November 2017 at:

Canton Beach Holiday Park at 10.30am
Norah Head Holiday Park at 1.30pm
Budgewoi Holiday Park at 3pm

The auctioneer will provide one viewing day for all below auctions on Friday 10 November 2017 from 10am to 1pm.

The auction is for the sale of lots:

Canton Beach Holiday Park – 8, 69, 89, 121, 133, 162, 223, 254, 279, 488, 498, 508 & 512
Norah Head Holiday Park – 79, 84, 171 & 262
Budgewoi Holiday Park – 15

The conditions of sale for any lot are as follows:

a. The auction is for the sale of a collection of goods by specific lots, such lots which may include a caravan, manufactured dwelling, annexe and other goods.
b. All bidders must register with the auctioneer, and present photo identification, in order to participate in the auction and place a bid. Registration details of all bidders will be provided to the seller.
c. All bidders must wear safety footwear, and must comply with any reasonable directions of the auctioneer or the seller when accessing the site of the auction.
d. Lots are subject to a reserve price.
e. The seller reserves its right to bid for any lot.
f. The lot will be sold to the highest bidder, unless the reserve price is not reached, in which case, the highest bid will not be accepted by the seller, and no contract for the sale of the lot will be formed.
g. A buyers commission applies, and is payable in addition to the successful bid. The commission is 20% of the successful bid under $10K & 10% commission of the successful bid over $10K.
h. The sale of each of lot is only for the sale of the physical goods (including any manufactured home, caravan, annexe and other goods) forming part of that lot. No licence to occupy the site and land on which the lot is located is offered by the seller.
i. Payments (including the buyers’ commission) must be made directly to the auctioneer, on the day of the auction.
j. Collection and removal of the lot must be carried out within 10 days of the completion of the auction,  unless other arrangements are made with the seller.
k. The seller reserves its right to remove, sell or otherwise dispose of the lot without notice, if collection and removal is not carried out within 10 days of completion of the auction, or in accordance with any  other agreement made.
l. Title in the lot only passes on payment for, and collection and removal of the goods forming part of the lot.
m. All lots are sold as is, no warranties as to quality are made by the auctioneer or the seller.
n. The buyer understands and agrees to the terms of the sale. Special conditions:
o. Successful bidders for lots 79 & 262 Norah Head Holiday Park may submit a request to the seller to enter into a licence agreement pursuant to the Holiday Parks (Long-term Casual Occupation) Act 2002 (“Act”), for the use of the site on which the lot is located. Any requests to enter into such a licence agreement must be made to the seller within 48 hours of completion of the auction.
p. In the event such a request is made, the successful bidder is not required to collect and remove the lot from the site, unless the seller declines (at its discretion) to enter into such a licence agreement, in which case, the successful bidder must collect and remove the lot from the site, within 7 days’ notice of the seller’s decision. The seller reserves its right to remove, sell or otherwise dispose of the lot without notice, if collection and removal is not carried out within 7 days’ notice of the seller’s decision not to enter into a licence agreement.
q. In the event the seller and the successful bidder agree to enter into such a licence agreement, title in the lot passes on the date of commencement of that licence agreement.
r. Nothing in these terms should be construed as a representation that the seller will enter into any licence agreement.

Successful bidder may submit a request to the seller to enter into a licence agreement pursuant to the Holiday Parks (Long-term Casual Occupation) Act 2002 (“Act”), for the use of this site. Any requests to enter into such a licence agreement must be made to the seller within 48 hours of completion of the auction and is subject to the successful bidder meeting the requirements outlined in and sign the disclosure statement. In the event the seller declines (at its descretion) to enter into such a licence agreement the bidder must collect and remove the lot from the site, within 7 days notice of the sellers decision. The following works are required to be undertaken prior to the seller considering to enter into a licence agreement;
• Paint – Van, Annex and Deck
• Paint steps
• Remove blinds and fixtures off Awning (broken blinds)
• Remove items off deck and around annex (rusted gas bottle and items at back of annex)
• Remove or replace rusted A/C unit at side of Annex
• Replace lattice with skirting (some missing)
• Paint or remove metal awnings over windows
• Remove rusted fixtures on Annex roof at corner of back of annex
• Remove or replace clothesline (lines are broken and it is a solid structure that does not fold down)
• Remove paving at back of annex
• Remove small fixtures on side of van
